Terms of Service

In plain English Use MixSleuth to identify tracks in your own mixes. Free Shazam identification is limited; paid plans and credits unlock more. Don't try to cheat the limits or resell the service. Track matches are best-effort — clever software, but not guaranteed perfect.

These Terms govern your use of the MixSleuth Mac app and the mixsleuth.com website (together, the "Service"), operated by a sole trader trading as MixSleuth ("we", "us"). By installing or using the Service you agree to these Terms. If you don't agree, don't use the Service.

1. Licence

We grant you a personal, non-exclusive, non-transferable licence to install and use MixSleuth on devices you own or control, for your own DJ and music work. You may use it commercially as a working DJ. You may not redistribute, resell, sublicense, or make the Service available to others as a paid or bulk service.

2. Plans, credits and limits

  • Free — includes a monthly allowance of Shazam-based identification (for example, a set number of minutes of audio analysed per month). Some features, such as exporting tracklists, may require a paid plan.
  • Paid plans — unlock unlimited Shazam identification and/or an allowance of premium ("AudD") identification, sold as a subscription, a licence, and/or prepaid credits. A credit is consumed when a premium identification runs, as described in the app at the time.

We may adjust allowances, credit definitions and prices over time. Any change applies to future purchases and renewals; the price and terms shown to you at the time of purchase are what apply to that purchase. Credits and allowances have no cash value and are not transferable or refundable except where required by law.

3. Billing, renewals and refunds

Purchases are handled by our payment providers, who act as merchant of record:

  • Mac App Store purchases and subscriptions are billed by Apple and governed by Apple's terms. Manage or cancel renewals, and request refunds, through your Apple account.
  • Direct purchases are billed by a third-party merchant of record (such as Polar or Paddle), who issues your invoice and licence and handles applicable taxes. Their purchase terms and refund policy apply to those orders.

Subscriptions renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period.

4. Acceptable use

You agree not to:

  • circumvent, automate around, or attempt to exceed free-tier limits, quotas, or credit metering (for example by splitting or re-uploading files to harvest free results);
  • reverse-engineer, decompile, or extract the Service except to the limited extent the law allows;
  • use the Service to infringe copyright or other rights, or to process audio you have no right to process;
  • resell, rebrand, or provide the Service's identification as your own paid service; or
  • interfere with, overload, or disrupt the Service or its relay infrastructure.

5. Third-party identification services

MixSleuth uses third-party recognition services — Apple ShazamKit and AudD — to identify tracks. Your use of those results is also subject to those providers' terms. Where match metadata is provided by Apple, the app links the matched track to Apple Music in line with Apple's requirements. We don't control these services and aren't responsible for their availability or the accuracy of their data.

6. Intellectual property

The Service, including its software, design, and the MixSleuth name and logo, is owned by us and protected by law. Your mixes, your music library, and the tracklists you produce remain yours.

7. No guarantee of accuracy

Track identification is best-effort and probabilistic. DJ mixes pitch, EQ, blend and overlap tracks, and not every track exists in any catalogue. We do not guarantee that every track will be identified, or that every identification is correct. Always check results before relying on them.

8. Warranties and liability

The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect or consequential loss, lost profits, or lost data, and our total liability arising from the Service is limited to the amount you paid us for it in the 12 months before the claim.

9. Termination

You may stop using the Service at any time. We may suspend or end your access if you materially breach these Terms (for example, by abusing the limits in section 4). Sections that by their nature should survive termination will do so.

10. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, and disputes are subject to the courts of Hong Kong — without affecting any mandatory consumer-protection rights you have where you live.

11. Changes

We may update these Terms as the Service evolves. We'll update the "last updated" date and, for material changes, give reasonable notice. Continuing to use the Service after a change means you accept the updated Terms.
