Terms of Service

These Terms govern your use of the MixSleuth Mac app and the mixsleuth.com website (together, the "Service"), operated by a sole trader trading as MixSleuth ("we", "us"). By installing or using the Service you agree to these Terms. If you don't agree, don't use the Service.

1. Licence

We grant you a personal, non-exclusive, non-transferable licence to install and use MixSleuth on devices you own or control, for your own DJ and music work. You may use it commercially as a working DJ. You may not redistribute, resell, sublicense, or make the Service available to others as a paid or bulk service.

2. Membership, credits and limits

• 30-day free trial — every download begins with a 30-day trial that includes unlimited scanning against your own local library, unlimited single-source online identification, and unlimited tracklist exports, with no credit card required. The trial does not include multi-source ("Deep") identification. When the trial ends, the app continues as a free local-library scanner until you upgrade.
• MixSleuth Pro membership — a $4.99/year auto-renewing subscription. It includes unlimited scanning against your own local library (no credits needed), unlimited tracklist exports, and one Monthly credit per month — a single-source online-identification scan covering a mix of up to 60 minutes. A one-time welcome bundle of 5 MixSleuth Credits is granted with your first paid term (not during the free trial).
• MixSleuth Credits — prepaid credits, sold as one-time packs, that fund multi-source identification scans (Deep identification included). One credit covers one multi-source scan of up to 60 minutes of mix and is charged when the scan starts; longer mixes scale proportionally (a 90-minute mix uses 1.5 credits). Credits never expire.
• Failed scans — if a scan fails before doing any paid identification work, its credit is refunded automatically. Otherwise a scan's charge is final once the scan has run; contact [email protected] for anything else.
• If your membership lapses — the app locks and credit spending pauses. Your credit balance is preserved and becomes usable again when the membership is active again.

We may adjust allowances, credit definitions and prices over time. Any change applies to future purchases and renewals; the price and terms shown to you at the time of purchase are what apply to that purchase. Credits have no cash value and are not transferable or — beyond the automatic failed-scan refund above — refundable, except where required by law.

3. Billing, renewals and refunds

Purchases are handled by our payment providers, who act as merchant of record:

• Mac App Store purchases and subscriptions are billed by Apple and governed by Apple's terms. Manage or cancel renewals, and request refunds, through your Apple account.
• Direct purchases are billed by Polar, a third-party merchant of record, who processes the payment and handles applicable taxes and receipts. Polar's purchase terms and refund policy apply to those orders.

The membership renews automatically each year until cancelled. You can cancel at any time, effective at the end of the current billing period — access continues until then. The 30-day free trial is separate and requires no payment details: it simply ends after 30 days, and you are only ever charged if you choose to buy a membership.

4. Acceptable use

You agree not to:

• circumvent, automate around, or attempt to exceed trial limits, quotas, or credit metering (for example by splitting or re-uploading files to harvest free results);
• reverse-engineer, decompile, or extract the Service except to the limited extent the law allows;
• use the Service to infringe copyright or other rights, or to process audio you have no right to process;
• resell, rebrand, or provide the Service's identification as your own paid service; or
• interfere with, overload, or disrupt the Service or its relay infrastructure.

5. Third-party identification services

MixSleuth's online identification uses third-party music-recognition services — Apple's recognition service for the standard (single-source) pass, and a specialist recognition catalogue for deep (multi-source) scans. Your use of those results is also subject to those providers' terms. Where match metadata is provided by Apple, the app links the matched track to Apple Music in line with Apple's requirements. We don't control these services and aren't responsible for their availability or the accuracy of their data.

Discogs metadata enrichment (BETA). MixSleuth can optionally enrich identified tracks with metadata — album art, label, year, genre — sourced from Discogs, the community-built music database. We love Discogs and are grateful to its contributors, but MixSleuth is an independent product and is not affiliated with, endorsed by, or sponsored by Discogs. Discogs data is contributed by volunteers and may be incomplete, inconsistent, or incorrect. We are not responsible for the accuracy, completeness, or availability of any metadata or artwork shown. Metadata and artwork are provided for your convenience only and remain the property of their respective rights holders. Where a Discogs link is provided, it points to the Discogs release page — your use of Discogs is subject to Discogs' own terms of service.

Apple Music metadata. MixSleuth enriches identified tracks with metadata and album art from the iTunes Search API and Apple Music. Album art provided by Apple is displayed alongside a link to the track on Apple Music, in accordance with Apple's promotional content requirements. MixSleuth is an independent product and is not affiliated with, endorsed by, or sponsored by Apple Inc. We do not control the availability, accuracy, or completeness of Apple Music metadata or artwork. Apple Music and iTunes are trademarks of Apple Inc., registered in the U.S. and other countries. Your use of Apple Music is subject to Apple's own terms of service.

Cover Art Archive. Where album art is not available from your local files or Apple Music, MixSleuth may fetch it from the Cover Art Archive, a community-maintained archive hosted by the Internet Archive. MixSleuth is not affiliated with or endorsed by the Cover Art Archive or the Internet Archive. We do not control the accuracy or availability of artwork sourced from the Cover Art Archive.

6. Intellectual property

The Service, including its software, design, and the MixSleuth name and logo, is owned by us and protected by law. Your mixes, your music library, and the tracklists you produce remain yours.

7. No guarantee of accuracy

Track identification is best-effort and probabilistic. DJ mixes pitch, EQ, blend and overlap tracks, and not every track exists in any catalogue. We do not guarantee that every track will be identified, or that every identification is correct. Always check results before relying on them.

8. Warranties and liability

The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect or consequential loss, lost profits, or lost data, and our total liability arising from the Service is limited to the amount you paid us for it in the 12 months before the claim.

9. Termination

You may stop using the Service at any time. We may suspend or end your access if you materially breach these Terms (for example, by abusing the limits in section 4). Sections that by their nature should survive termination will do so.

10. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, and disputes are subject to the courts of Hong Kong — without affecting any mandatory consumer-protection rights you have where you live.

11. Changes

We may update these Terms as the Service evolves. We'll update the "last updated" date and, for material changes, give reasonable notice. Continuing to use the Service after a change means you accept the updated Terms.
